The Customer acknowledges and agrees that:
- All content uploaded, distributed, or otherwise made available by the customer through Xage1’s IMS (Interactive Management System) is the sole responsibility of the Customer.
- The Customer is responsible for managing user accounts, including safeguarding personal information (personal data is defined here as any information that relates to an identified or identifiable individual and includes names, contact details, identification numbers, financial information, and any other data that can be used to identify a person), including for the purposes of distribution of rewards and benefits to users.
- The Customer will comply with all applicable laws and regulations related to the content and use of the Xage 1 IMS (Interactive Management System).
- All content, users, and distribution of rewards are the sole responsibility of the Customer. The Provider shall not be held liable for any claims, losses, or damages arising from the Customer’s content or any actions taken by the Customer in relation to the IMS (Interactive Management System).
5. Account Creation and Security
To access certain features, you may be required to create an account. You must provide accurate and complete information during the registration process and keep your account details up to date. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. If you suspect any unauthorized use of your account, you must notify us immediately.
6. Intellectual Property
All content, trademarks, and other intellectual property on our website are owned by us or our licensors. You may not use, reproduce, distribute, or modify any content without our prior written consent.
7. User-Generated Content

The Customer agrees that all content, users, and distribution of rewards are the sole responsibility of the Customer. The Provider shall not be held liable for any claims, losses, or damages arising from the Customer’s content or any actions taken by the Customer in relation to the IMS (Interactive Management System).
11. Indemnification
Indemnification by Customer: The Customer agrees to indemnify, defend, and hold harmless the Provider, its affiliates, officers, directors, employees, and agents (collectively, “Indemnified Parties”) from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorney’s fees) arising out of or related to:
- The Customer’s use of the app or services provided under this Agreement.
- Any violation of applicable laws or regulations by the Customer.
- Any breach of this Agreement by the Customer, including any representations or warranties made herein.
- Any claims made by third parties as a result of the Customer’s actions or omissions.
- Breach of the privacy policy clause.
Notification of Claims: The Indemnified Provider shall promptly notify the Customer of any claim for which indemnification is sought. The Administrator shall have the right to control the defense and settlement of any such claim, provided that the Indemnified Parties may participate in the defense at their own expense.
Limitations: This indemnification obligation shall survive the termination or expiration of this Agreement.
12. Governing Law
This Contract shall be governed by and construed in accordance with the laws of Contra Costa County, California.
13. Changes to This Privacy Policy
We reserve the right to modify or update this Privacy Policy at any time. Changes will be effective upon posting the updated policy on our website or app.
